EU Posted Driver Declarations: A Guide for UK Hauliers
Decide when cabotage or cross-trade makes a driver posted, submit the declaration and retain transport, tachograph and pay evidence.
A UK driver crossing into the EU is not automatically a posted driver for every journey. Posting rules focus on particular operations, especially cabotage and cross-trade. The transport office must classify the work before departure, submit the declaration where required and retain evidence that agrees with the actual route.
This is an EU labour-compliance layer alongside drivers’ hours, tachographs, operator licensing and cabotage rules. It does not replace any of them.
Classify each leg
EU guidance identifies cabotage—domestic transport in an EU country where the employer is not established—and cross-trade between countries where the employer is not established as posted-driver operations. Bilateral and transit operations can be treated differently under the rules.
Map every loaded and empty leg, collection and delivery country, and the employer’s country of establishment. Do not classify a multi-leg tour from its first and last points only.
Where the pattern is complex, use the European Commission Q&A and specialist advice. A wrongly assumed exemption can affect declarations, pay and roadside documents.
Submit the declaration before posting
The employer submits the posting declaration through the EU road transport posting portal for the host country. Keep company, transport manager/contact, driver, licence and operation details accurate.
Set a control for expiry and changed drivers. A declaration copied from a previous tour may name the wrong worker or omit a host country.
Documents the driver needs
EU guidance says the driver should have:
- a copy of the posting declaration, electronic or paper;
- evidence of the transport operation in the host country, such as a consignment note;
- tachograph records.
Make these accessible at roadside without exposing unrelated employee data. Check the CMR, posting declaration and tachograph country entries tell the same operational story.
Pay and employment evidence
Host authorities can request payslips, proof of payment, tachograph records, time sheets, transport evidence and the employment contract after the operation. The employer may have to comply within the portal process and deadline.
Remuneration rules vary by country. The EU portal links to national information. Do not use one generic EU hourly rate or assume normal UK pay automatically satisfies every host requirement. Payroll and competent employment advice should confirm the calculation.
Create a posting case file
For each declaration period or driver, retain:
- operation classification and reasoning;
- submitted declaration and reference;
- CMRs and job records;
- tachograph and time evidence;
- host-country remuneration source and payroll working;
- payslip and payment evidence;
- authority requests and responses;
- exceptions or corrected declarations.
Use access controls because employment and pay documents are sensitive. The transport planner may need declaration status without access to payroll.
