Adding Vehicles or Trailers to an O-Licence: Margins, Variations and Interim Authority
A spare margin is not unlimited authority. Use this decision tree before adding vehicles, trailers or operating-centre capacity to an O-licence.
A vehicle can be physically available, insured and roadworthy but still not be authorised under the operator’s licence. Before dispatching new, replacement or hired capacity, check both the licence total and the allocation at the relevant operating centre.
Authorised versus specified vehicles
The licence sets a maximum number of motor vehicles and trailers that may be used. Motor vehicles are also specified by registration through the Vehicle Operator Licensing service.
“Margin” commonly describes unused space between the number currently specified or normally operated and the authorised maximum. It is not permission to exceed that maximum or the centre allocation.
Example:
- Licence authority: 10 vehicles and 12 trailers.
- Currently specified/operated: 8 vehicles and 10 trailers.
- Apparent margin: 2 vehicles and 2 trailers.
Before using it, confirm the specific operating centre has capacity and no condition limits the proposed asset or work.
Adding a motor vehicle within authority
Current GOV.UK guidance says additional vehicles can be specified up to the maximum. If there is no margin, the vehicle must be recorded immediately; where margin exists, the guide states it must be recorded within one month of coming into possession.
Do not turn that one-month rule into routine delay. Specifying before first use keeps discs, enforcement records and the fleet register aligned. Check the current service instructions for hired or replacement vehicles and ensure the correct disc is displayed where required.
Removing a returned or sold vehicle keeps the record accurate but does not increase the licensed maximum; it simply restores unused authority.
Trailer authority
Trailers are authorised by number rather than specified individually in the same way as motor vehicles. The number used at any one time must stay within total and centre authorisation.
Maintain an internal trailer register anyway. Include identity, ownership, location, inspection status and whether it is active. Hired and customer trailers can count towards operational use even though they are not owned.
When a chargeable variation is needed
Apply for a variation to:
- increase overall motor-vehicle or trailer authorisation;
- increase capacity at an operating centre;
- add a new operating centre;
- change conditions attached to a centre.
GOV.UK advises applying at least nine weeks before the increased capacity is needed. The Traffic Commissioner may require financial, professional, maintenance, centre and environmental evidence.

Interim direction: request is not grant
Where capacity or a centre is needed within nine weeks, the operator may request an interim direction as part of the complete variation. The Traffic Commissioner may grant temporary authority while the application is considered.
Three controls matter:
- Apply for the full variation; an interim does not replace it.
- Do not use the extra authority merely because it was requested.
- Read the actual grant, scope, conditions and expiry.
An interim may expire on a stated date, when the main application is decided, withdrawn or refused. Keep the decision visible to dispatch.
Decision tree before use
Capacity exists
Confirm total and centre authority, specify the vehicle through the official service, update the fleet register and inspection planner, then verify documents before dispatch.
Total exists but centre capacity does not
Do not simply park or operate it from that centre. A variation or reallocation may be required. Check operating-centre conditions and obtain advice.
Authorised total must increase
Submit a chargeable variation with evidence. Wait for grant or an actual interim direction.
A new legal entity will use the vehicle
This is not solved by a fleet variation. Licences are not transferable; the entity may need a new application and interim licence.
Fleet register reconciliation
At least monthly, compare:
- licence-authorised totals;
- centre allocations;
- specified registrations;
- vehicles in possession;
- active hire vehicles;
- trailers in use;
- discs and documents;
- maintenance planner;
- insurance and driver assignment.
Investigate differences. A vehicle returned to the hirer but left specified can obscure the true fleet; a replacement operating without specification creates enforcement risk.
Bringing the asset into service
Licensing authority is only one gate. Confirm insurance, tax/test where applicable, safety inspection and first-use evidence, brake assessment, recall status, defect process, suitable driver and combination weights.

- Counting vehicles only and forgetting trailer authority.
- Treating the overall total as capacity at every centre.
- Using a vehicle while an interim request is undecided.
- Assuming a hire company handles O-licence specification.
- Applying for extra vehicles after contracts start.
- Moving a vehicle to a centre not authorised for it.
- Forgetting to remove returned vehicles and reconcile discs.
- Confusing a new entity with a variation.
Digital fleet records can flag mismatches and future needs, but changes must be made through the official licensing process.
